Successful immigration application

 Dear AM Forum Family

I just received the wonderful news that my application to become a permanent resident in Australia has been approved ;D

It has taken 2 and 1/2 years and at times been quite fraught though today I am victorious !!! I had a very uphill struggle as Australia does not allow persons with HIV to immigrate. Having said that there are exceptions and I am quite thrilled to say that I am one of them. I presented a compelling and convincing case to both the Department of Immigration and the Medical Officer of the Commonwealth on the basis of being a Long Term Non Progressor. I had been rejected twice before with my application. I had an excellent immigration agent who has worked with both gay and lesbian couples and persons with HIV. He had much success over the years in representing both communities.

The message I would also like to put forth here is that one person can confront a national immigration agency and become successful. My case has now set precedent in Australia and may hopefully make it easier for those who follow.

I now get to stay in Australia with my Australian partner. I will take out Australian citizenship in two years and also keep my American citizenship.

In my time here at the Forums I have gained strength and courage by the many compelling people and your stories and how we may succeed and sometimes make a difference in the world. I dedicate this day to all of you and the millioms of others who continue to struggle and sometimes prevail in the face of sometimes overwhelming odds.

This is just wonderful news, Paul. I don't like using exclamation marks all that much, but... !!!!!!!!!!!!!!!!!!!!!!!!

Wow. As you say, a precedent has been set. Case law is mind-bogglingly intricate and confusing; but one precedent just might lead to another, which might in turn... &etc.

Congratulations. Very happy for you and your partner.

Your story is also a reminder how important it is in these situations to get an excellent lawyer to represent you; and excellent not just in terms of knowing the law but also fully sympathetic to what you're fighting for.

Congratulations I hope you have a wonderful life here in Australia. I wish you and your partner all the best. Australia is a great place to live.

I leave for Canada next week. I will be getting married on March 4th to my beautiful husband to be. I will be going through the whole process myself. I hear it is easy to immigrate to Canada. My partner has tested HIV+ and I hoped that some day he would come and settle in Australia. I didn't know that Australia has a restriction on HIV+ person wanting to immigrate.

Paul, all I can say is I'm SPEECHLESS! In my mind, there was never any doubt that this would go through and I'm so glad and relieved that the tribulation has come to a close. I wish you two the best and don't forget, I hold you two to the promise you guys made about me spending time in Australia at your plant-named rooms.

Thanks so much !! Yes,  you are always welcome here at our place in Australia. Remember the best time to come is our spring ( Sept.) when the native orchids are blooming on the track behind the house.

We hope to come to DC this June when I'll participate again in the NIH study. We look forward to seeing you again then.
