HIV assistance in ft lauderdale
« on: November 03, 2016, 01:45:45 pm »
Job has stressed me out to the point of being a functional depressed individual which is affecting my health.  Can Someone  point me in the right direction of receiving benefits due to my HIV status. Taking a sick leave from work? Really want to resign all together ideally.
TY All.

By your posted "name," I presume you are a firefighter?  In any case, check with your Human Resources Department and see about whatever "disability" process, if any, afforded you in your workplace.  Of course, you don't have to tell them anything, just check it out.

The determine whether you meet any given criteria for disability due to depression and/or HIV infection.  Disability for HIV infection may have objective and/or subjective criteria such as CD4 numbers or presence or history of aids-related opportunistic infections.  Depression may have similar criteria.

Your workplace may need to offer you a "reasonable accommodation" to assist you in remaining in your job.

Of course, if either a "reasonable accommodation" or disability retirement is available to you, medical records and the opinion of doctors will need to be
produced.

You may wish to see a disability lawyer, depending on what options you may have.

Social Security also has a disability process, but you won't be considered for it if you are working.  You can check social security here:

https://www.ssa.gov/disabilityssi/

In the alternate, and less drastically, you may wish to seek some sort of "medical leave of absence" under the provisions of the federally mandated Family Leave and Medical Act (FLMA) which can be viewed through this link:

https://www.dol.gov/general/topic/benefits-leave/fmla

Accessing the FMLA will protect your job for you, when you wish to return to it.

Do be aware, that if you choose some of these routes, the process can be arduous, but the final result does comport with existing facts and, where applicable, law.

If you have strong CD4 numbers, your HIV might not be considered a "disability" per se.  Medical documentation and a physician's opinion will be crucial.

Of course, I have no knowledge of your financial resources or age, so I would advise you to think over any options carefully before you seek to leave the job market, either through disability or a simple resignation.

Good luck. I wish you the best in maintaining your physical and mental health.
