Copay Accumulator Ban

I’ve one of many individuals who has been hit with the copay accumulator added to my health insurance several years ago. My husband has had it even longer. What this results in is that we both end up paying the full $6k every year after our health insurance/PBM has drained the copay assistance card.
With the recent ruling out of the district court in DC, I thought all copay assistance cards now had to be required to apply to deductibles/max out of pocket. But nope…both my insurance and my husbands insurance are refusing and saying they don’t have to. I’m so confused!?
