BREAKING NEWS:
      JUDGE STEPS DOWN, HEARING VACATED

WASHINGTON, D.C.  -  Only 23 hours before Lt. Dan Choi's scheduled criminal hearing, Magistrate Judge Elizabeth C. Wingo, recused herself.  The recusal and unprecedented delay is based upon Lt. Choi's motion related to Government Misconduct. Over 30 officials, including Former Press Secretary Robert Gibbs and Former White House Deputy Chief of Staff Jim Messina were subpoenaed to testify about their political roles in the Repeal of Don't Ask Don't Tell (2010) and the Tarsands Keystone XL Pipeline Protests (2011).

Lt. Choi has been on trial for over one year and is prohibited from stepping foot on the White House Sidewalk. Lt. Choi's attorney, former Army JAG Officer Capt. James E. Pietrangelo II remarked "there is something very wrong here. We subpoenaed White House Officials and all of a sudden the hearing is cancelled." Professional Process Server Mr. Daniel Portnoy of D.C. Legal Process has "never seen this before in over 700,000 high level subpoenas served in over a decade."

The hearing tomorrow is cancelled, incurring Lt. Choi over $5000 in legal preparation and travel fees.

Lt. Choi is still on trial for protesting Don't Ask Don't Tell in federal court, and a hearing in that separate case is still set for October 17, 2012. Further details about the rescheduling of the vacated Tarsands Case will appear on this site. The Tarsands case will likely go before the Chief Judge of the Superior Court, Chief Judge Lee Satterfield unless he reassigns it.

WHITE HOUSE OFFICIALS OBSTRUCTING JUSTICE IN
LT. DAN CHOI PROTEST TRIAL

   Two criminal trials continue against Lt. Dan Choi, discharged under Don't Ask Don't Tell in 2010. Lt. Choi is charged for protesting the anti-gay policy and the TarSands Keystone XL Pipeline, more than 700 days after the protests.

   Wednesday 9/26 at 11am, D.C. Superior Court Magistrate Judge Elizabeth C. Wingo will hear arguments and testimony from several White House officials regarding the Keystone XL Pipeline Protests.

   Subpeonas have ordered testimony and documents from Former White House Press Secretary Robert Gibbs, Senior Presidential Advisor Valerie Jarrett, US Park Police and US Secret Service personnel. Evidence of a pre-planned arrest and federal charge, 3 days before the protest occurred in November 2010, have already been presented.

   Several attempts to dismiss charges have failed and the prosecutors in each case seek the maximum 6 month federal prison sentences. As a condition of his pre-trial release, Lt. Choi is prohibited from stepping on the White House Sidewalk. For more than one year, he has obeyed that court order.

   Lt. Choi has filed several motions to defend himself: 

         1. Former White House Officials Evade Subpoenas.
         2. Prosecutor Concealed Critical Evidence from Defense.
         3. Selective, Vindictive, Illegal Prosecution.
         4. Lt. Choi prevented from US Army Enlistment Solely Due to These Cases.
         5. Prosecutor Refuses to Address Gay Veterans by Rank, Despite Judge's Order.
         6. Lt. Choi incurred a $3000 Don't Ask Don't Tell "Discharge Debt" still unforgiven.

   Lt. Choi is represented by a former JAG Officer, Army Captain James E. Pietragelo II (discharged under DADT 2004) in the local trial (D.C. Superior Court). Trial is open to the public, and a Press Conference will be held immediately following the proceedings, in front of the Moultrie Courthouse, facing Indiana Avenue.

The man is a hero. He should be treated as such. I think the Obama administration would do well to rectify this outrage.

"Many people, especially in the gay community, turn to oral sex as a safer alternative in the age of AIDS. And with HIV rates rising, people need to remember that oral sex is safer sex. It's a reasonable alternative."
