Hi Everyone,

Im from the Philippines, I just wanna ask if the USA is not discriminating people living with HIV from work or employment opportunities why are the employers from US requiring HIV test for their applicants and refusing to hire &/or petition for a working visa those who tested positive?

Of course applicants from our country are hired by the employers thru agencies and these agencies/employers makes hiv positive applicants "unfit to work" even if they are not sick and very capable to do the work. I am particular to those in the health field (health workers).

Being unfit to work means you failed the medical exam & therefore would not be hired by the employer which also means not filing for a petition on H1B Visa (working). SO how are we gonna be able to work in the US if this is the process? Where is that thing they call "equal opportunity"

What do you mean specifically when you say trying to bring the cost of health care down?

It sounds like a classic case of corperations  and insurance companies trying to keep the cost of healthcare down .

When business enroll people with expensive health conditions into a plan it drives the cost up for all the group members or the company … This is my basic understanding and I am in no way an expert or particularly knowledgeable about insurance issues … its just my best guess .

Ow I get it. So because of that there's no way pozzies like me can work in the US? its very sad... Even if I apply in an HIV institution they won't accept. The agency would just tell me that I am HIV+ and I can't work in the US

I hope you understand that I do not know the reason and what I said was something I just had a hunch is a factor . American insurance companies have just in the last few years to been required to offer insurance to U.S. citizens with preexisting conditions so I am not surprised it’s a factor for work visa’s .

I hope you understand that I do not know the reason and what I said was something I just had a hunch is a factor . American insurance companies have just in the last few years to been required to offer insurance to U.S. citizens with preexisting conditions so I am not surprised it’s a factor for work visa’s .

Thank you for being honest. I hope someone could help me land a job in the US. Life here is very difficult economically. We really need to work abroad to provide for the family. I am willing to do any kind of work in the US. Even an au pair

It may still be possible so do not let anything I say dissuade you from chasing your dreams and moving forward in life . Im going to move this thread in the insurance forum and perhaps JR can advise .

Sounds like the hiring is done in the Phillipines, and would be subject to Phillipine laws regarding hiring discrimination and HIV.  Once you got to the US, you would be covered by our anti-discrimination laws. 
It goes like this
