I live in CA and kind of confused with all the posts everywhere with disclosure laws.  I thought disclosure is needed only if doing vaginal or anal sex.  Can someone clarify?  Thank you

california is one of the better states in their disclosure/exposure laws

State laws regarding the criminalization of HIV are, of course, determined State by State, so they vary.

The attached link includes a .pdf file, updated in 2015, that identifies criminalization laws State by State.  Feel free to peruse at will.  In answer to your question, as far as I can tell, criminalization (non-disclosure) laws concerning HIV transmission through sexual activity in the State of California is defined as unprotected anal or vaginal sex. You may wish to confirm the current status of California law by contacting a local HIV advocacy organization.

god, thats depressing reading.

It's amazing to me that such variations exist and some of these states wilfully ignore any scientific evidence regarding transmission routes or advances with knowledge about things like viral-load.

I skim read about half the PDF and I think I only saw one state who acknowledged undetectable viral load as a potential defence.

At least here in the UK (Well, England and Wales at least), you have to have actually transmitted HIV to be prosecuted. It seems in some US states a bit of heavy petting could land you in jail.

You would hope that these legal statutes will be updated over time, but given it is 2016 and much of this stuff is so out of date, I'm not that hopeful.
