Suing the hospital for negligent use of equipment
« on: September 06, 2016, 02:25:04 am »
Hi
Is it possible to sue the hospital for using HIV infected blood for transfusion or infected syringes?
The problem is, even if blood donors get tested for HIV using the most effective test(RNA) , it still can't detect HIV if the donor was infected less than a week ago. Which means in case of patients that require blood transfusion, it's always assumed to be a risk?
In cases where hospitals reuse syringes, can a person sue the hospital?

Hospitals do what they can in order to screen blood, the risk in a western world location is tiny. Yes, there is a tiny risk but than again would you rather bleed to death instead of receiving care?

To be honest, your "what if" question has a simply answer: I don't know if you can sue them and to be frank I don't care. We are not here to give you legal advice.

You should not be posting here, this question has nothing to do with you or HIV prevention.

Take this note: Don't post in this thread again or outside of your own "Am I infected" topic again. If you do I will ban your account permanently. You have been warned.

There were more than 2000 people who got infected via blood transfusion. Indian hospitals aren't very careful while using medical equipment.

Yes, you are.

It has sod all to do with your personal HIV prevention. You just looking to troll and flame the forum.  In a western world location the risk is tiny because of the screening process and in 3rd world locations its getting better.

Again would you rather bleed to death instead of receiving care? No and your post is about suing people not the concern of being infected at all just looking for a pay out is that the angle here and is that all you care about?

Ill say it again to be honest, your "what if" question has a simply answer: I don't know if you can sue them and to be frank I don't care. We are not here to give you legal advice or to debate it with you. I think its sad and reflects on your thinking that you leap from risk to suing in the opening title. Why people think like this in world is part of what is wrong with the world.

I travel for work including to 3rd world locations and if I have an accident god forbid and I survived but had something go wrong I would be thankful that they saved my life not be looking to sue some poor hospital that did its best with the tools it had to save my backside.

You should not be posting here, this question has nothing to do with you or HIV prevention. Get a life and move on already, go pick a new illness to troll instead of HIV.

Goodbye and don't come back, you are banned.

Edit spelling.

yeah, i do. and i want to call you a whole lot worse too, but i try to respect our TOS.

we're not here to entertain every irrational fear someone cooks up. you ran out your free questions on the "Am I Infected?" board, and now you've crossed over to the open boards with ridiculous hypothetical scenario that is a little offensive to those of us living with HIV... as in, us, the members of these boards.

i suggest you take your question to an attorney trained in Indian law.
