Hate crime

My ex-wife called my business agent to inform him that I have AIDS. Does this constitute a hate crime?

No ... this is not a hate crime or even libel if its true . Its a despicable thing to do but not a crime .

I can't see how it would be, although it is a totally shitty thing to do.

Also, FYI, it is NOT a HIPAA violation either.

Our opinion is not the one that matters.  Depending upon where you live, it may be illegal to disclose the status of another person, which would make it a civil crime and not criminal.  Check the laws where you live, to see if any crime has been committed.

Current Meds ; Viramune / Epzicom Eliquis, Diltiazem. Pravastatin 80mg, Ezetimibe. UPDATED 2/18/24
 Tested positive in 1985,.. In October of 2003, My t-cell count was 16, Viral load was over 500,000, Percentage at that time was 5%. I started on  HAART on October 24th, 2003.

 UPDATED: As of April, 2nd 2024,Viral load Undetectable.
CD 4 @593 /  CD4 % @ 18 %

Lymphocytes,total-3305 (within range)

cd4/cd8 ratio -0.31

cd8 %-57

Fortunately I did not lose my job over it but that is what she was trying to accomplish. She may say she was warning him so that when we shake hands he can put on rubber gloves first.

He flat out told me my wife called and told him that I have AIDS. The he asked me flat out if it was true. I told him yes but I wasn't planning on sharing it with everyone in my local union.

This would be protection under hate crimes if someone beat you up etc., because you had or they thought you had HIV/AIDS (even if you didn't).

Losing your job because of it would be covered by the ADA.
