Question about employment with HIV

So I am attempting to get a job as a CNA at a hospital here in the USA, and was wondering if the ADA included hospitals as locations on whether or not they could descriminate when hiring, for safety of mainly yourself? I haven't been able to find anything on it after spending some time on google, so thought I would ask the next best place.

(If not the right area of forum to post, please put in correct forum)

I don't see why not if you're​ on treatment and undetectable.. but I'm not in the healthcare field.. I could only guess that if you are discriminated against bc of being hiv+, you might be able to file a law suit..

Maybe one of the members here who are in the healthcare field could elaborate more on this.. or maybe ask Dr Joel Gallant.. http://hivforum.tumblr.com

A NYC Man, who was offered a job as a police dispatcher, and had the offer rescinded after his medical exam that was required to start work when they learned he had HIV.  The US Dept of justice sued the City of NY and the man is now working at the job.  The judgement was that because just being HIV+ is considered a disability he was protected by a number of federal laws.

I would make sure to be truthful when filling out the medical questionnaire but also ask the person who you turn the form into if this information will be kept confidential and who will have access to your medical information.

Depends on the State. 

In some States your status has to be disclosed and signed off on by the patient prior to any invasive medical or dental procedure, effectively limiting or removing most job opportunities.   Can also keep you out of ED, ICU, and surgical units.  Pharmacists in some places are also forbidden from compounding any injectible meds.  Some States have removed notification requirements as long as the viral load is UD.  It's usually the same for other blood borne infections like Hep C.

I think CDC.gov has a list of requirements by State.

And no, it's not officially discriminatory or against the ADA since there is a risk and potential liability during invasive procedures. 

Also, as the other poster mentioned, be honest.  Any company can fire you for lying during the application process.  Hospitals will also all have a confidential coordinator who works with the State licensing boards and hospital and will know any limits.  You could try to talk to them first.
