Hi All

I have been practicing Massage Therapy just about a year now. I am currently city of San Diego licensed MT and own my practice and also work at a wellness center here in the city.

I recently got an awesome job at this really fancy Spa down in Chula Vista (city bit south of S/D). I meet all their requirement except that I am POZ. WTF really!!!!! They require you to get TB, HEP C. and HIV testing, and I am thinking that they are making you get tested for those so that they can deny your license based on the outcome.

I contacted legal council for people living with HIV here in S/D and going to get in touch with LAMBDA too. This is pissing me off.

Any other suggestion and wish me luck!

I'm sorry to hear this. Its just one more hurdle to have to jump over, isnt it. I have no idea what laws apply in California.
I just wish you luck.  Hey, maybe you should drum up a big POZ clientel....just a suggestion.

I don't why it would prevent you from being a Massage Therapist, when it doesn't prevent one from being a Dr., Physician Assistant, Nurse or a Paramedic.

THEY DO NOT HAVE THE RIGHT !!

it is incrimination, here in europe, you get a court case if you do that !!
it is after all just a Spa  centre not a hospital for god sake !! where are we heading ??
even in a hospital , they don't have the right.

my anger aside, it all depends on how much you need this job ??

if i were you , i go in and let them spend all the money to make the tests, always asking for a proof, and attack them after that !! everything they asking of you is illegal !!
they are just fretting above their ass , gosh , excuse my french !!

I agree with Rod and water duck, that doesn't sound right. Maybe you should check with local/state health authorities to see if that's legal. Is it the spa or the city that's asking for these tests?

I also live in San Diego and went to school for massage. I think the reason they do a hiv test is because massage licenses are regulated by the San Diego police department vice squad. Each state has its own laws on massage and then each city has its own regulations. Or, it may be Chula Vista's laws. You might not have to have an hiv test if you worked in San Diego proper. I think by testing, they are trying to cut down on hiv transmission because some massage places are fronts for prostitution and offer "happy endings".  Have you looked at NCBTMB's stance on hiv and testing?

yes, i am city of s/d licensed and currently practice in the city of s/d, just that c/v is backward in their stances....
