Aren't there actual laws in place, however, in some places at least, about homo's not being eligible blood donors.
The law excludes men who have had sex with other men since 1977. Not people of a given sexual orientation. And certainly not people who are "gay looking". If the man is really a feminine heterosexual as he claims, he has grounds to sue, IMO.

It is perfectly legal in most states to discriminate based on sexual orientation -- perceived or real.
I think he's doing the right thing by bringing them the bad P.R. -- because I don't think that he has a legal case.
