I had a car accident

Well yesterday was on my way to visit Lisa and was involved in a accident. I sit for three hours in the blizzard in my car waiting on the police to arrive which they never did! >:( My passanger side door is smashed in. Luckly I was not hurt. It did nothing to the other vechicle since he was driving a Landrover. I wrote down all the information from the other car. Called his insurance company this morning and his insurance had been cancelled.  >:( Spent most of this morning trying to get ahold of the North Carolina Highway Patrol no luck no answer. Now comes to bad news I will end up having to pay $200.00 to get it fixed myself. If the table was turned and I had hit someone I would have to have paid it. Really makes me mad too know that there are people out there that are driving without insurance.   >:( >:(

For what it's worth, it is illegal to hold an automobile registration if the automobile is not covered by insurance.  If you wrote down the license plate information for the Range Rover, getting in touch with the North Carolina Highway Patrol should prove fruitful. 

I thought you said there was an officer "right behind you" when the accident occurred (http://forums.poz.com/index.php?topic=6502.msg73782#msg73782)?  Regardless, don't give up on getting ahold with someone from the NCHP; I'm shocked that you haven't been able to so much as file a report with them.

   Jerry I ran into a very similar problem about 8 years ago.  I was hit by a kid who was drag racing and he did not have insurance.  The only thing I was able to do is have his drivers license suspended until he paid up.  I guess he did not need his DL that bad because it took him two years to pay me back, but he did.   In order to do it I had to get a lawyer..  I know this may not be an option for you at this time.   It sucks I know...  you may end up having to fix it yourself.

   I hate people that get away with things like this.  I can't believe someone who owns a Range Rover does not have insurance.  I would contact the police though.. there has to be something that can be done.

Did you contact your insurance company? They should be able to assist you...many policies contain an uninsured motorist clause that covers just what you are talking about. I would start with your own insurance company first...that is why you pay the premiums.

Jerry....Sorry to hear that.
If I am reading correctly....you say the damage will cost 200 dollars to fix.  For a sum so minor, I would just get it fixed.  Why mess with insurance.  I dont know what insurance you have and all but sometimes your insurance goes up with accident claims. Since the other driver had no insurance, your insurance agent might be the best person to talk to.

Thats a cheap door these days, my guess is that's a deductible? Get a report filed ASAP, and if need be,go to small claims court to get your $ back, without a lawyer.

Yeah it is for the deductible. Just a very depressed day to look out and see my car damaged and it happened in the wrong time of the year. Oh well my Christmas present to me.  >:(

I would still go to the police no matter what! Here in Alberta driving without insurance is a $2500 fine and carries enough demerits to possibly suspend someone's license. For him to do that and not have a single consequence would really be unjust!

Hey Tim yeah there was a policeman behind me but he was off duty at the time of the accident. Also it was out of his district. I guess the guy thinks he will get off scott free and won't have to worry about paying the bill on this one. Going to speak to the state police and get him though.

Hey Jerry,

The main thing is that you were not hurt in the accident. True enough it is a frustrating experience, however, material things can be replaced. As far as the offender, I agree with the others that you should follow-up with the Highway Patrol and even file a civil suit against the offender for the damages on your vehicle.

In this life, others need to understand that there is a reason to have insurance on their vehicle. Its not fair for the others to bear the cost of high insurance premiums and keep an active policy while the others do not.

Well update on my accident called the North Carolina Highway Patrol what a joke they were, they are going to do nothing about the whole situation. I called the accident in when it happened and they never came to the scene of the accident and had no information that the accident had even ever happened. So another honest driver gets screwed by the police. Well I guess it is time to take legal action on them and sue there pants off. Just really shocked me to know that the police officer I talked to said if I could get ahold of the guy that hit my vechicle and if he was willing to pay for the cost of the repairs on my car I should do that! ??? Really can't believe been driving and paying insurance on my vechicles since I was 16, and when it comes to myself getting involved and someone else hitting me I get screwed and they get off scott free! Well they have not heard the last of me on this situation It will be my turn taking them to court over this.  >:( >:( >:( >:(

Jerry, going to court will take a little time. First, walk in to the police department and demand they make an incident report! Up here in NY you have 10 days to make an incident report, if the police weren't at the scene.

Jerry -
File with the accident report with the police so there is a record of it.  Your insurance company should be assisting you in getting the other party to pay up.  If not, you do have the legal route but that's time consuming and costly.

Be glad you're not hurt and remember it's a car that can be fixed.  A good body shop will be able to have it back to you in a short period of time. 

The aggravation of the incident doesn't help but is it worth the stress?  We have insurance for a reason and the policy handles uninsured drivers.

Called the claims adjuster this morning and they are going to fix my car and all I will have to pay is the $200 deductable. Also the body shop is just 1 mile from my apartment so that is cool. ;D

If you talk to your insurance agent, they will probably be going after the un-insured driver in court for the monies they had to pay out, and may tack your $200 in with what they are going after.
