Is 10:30 PM too late to run a vacuum?

... in an apartment building?  My fucking lame neighbor just complained, and he also LIED and said it was 11 PM and it was actually 10:30 PM.

What fucking lame schedule does this man keep?  He's already complained about music months ago... when my stereo was on the 2nd lowest volume setting.

Get some coqui frogs and stick them in his apartment when he's not home.

The males' mating calls can get as loud as 100 decibels.   That's as loud as using a jackhammer indoors, by the by.

no way,, be serious,,,

be as loud as you can till 9 pm,,, usually in an apartment setting before 9 am and after 9 pm should be kept quite unless its an emergency, thats why apartment living sucks.

Hmmm... maybe I should not send him the letter that I just composed.

edit:  I just edited the letter and asked if he'd be so kind as to inform me of the best times to do such things, in line with his working hours.  He's complained previously about music even though my stereo was at the 2nd lowest volume setting.

The residents below him play music about 10 times the volume I do... and he should have heard the guy who lived in the unit he lives in now.  Talk about loud and LATE... like 2 AM and I never once complained.

I'm really just not a whiner.  This guy is the type that whines INSTANTLY... like it's not like I regularly vacuum at 10:30PM... it's just that my father is coming tomorrow and I was trying to get things done.  And since he complained about the music I've not once turned my stereo on!  I only listen to music through my iMac -- how tired is THAT?

ugh... I want to hit him.  I think he's a faggot too.  And he keeps his bicycle in the hallway even though I asked him not to, only as a "counter-whine" when he complained about the music.  Did he put the bicycle in his apartment?

He is... when he comes up and knocks on my door he's not even civil in asking about the noise, but nasty and demanding.  He obviously is lacking in "people skills."  Rather confrontational.  And you know, I'm a fairly quiet neighbor comparatively -- I never have parties and rarely even have visitors over.

I feel all I'm allowed to do is watch TV on the lowest volume and read books.  He must hate it when I play porn at 2am.

Oh, I fired off an email to my landlord (who likes me) the first time the asshole complained, because he'd threatened to call the police.  I wanted to reiterate what a freak he'd let in the building and to relate that my stereo's volume had been on the 2nd lowest volume marking.  I don't even own large speakers... just Bose bookshelf speakers.  They're small.

I'm afraid to turn on my subwoofer when I watch DVD's with surround sound!

I think part of it is coming from NYC.  Nobody bats an eye making noise before midnight.  Midnight is the cut off.  All other parts of the US are so incredibly parochial.

Oh, and mind you the vacuum was a real upright, but the actual vacuuming didn't even last longer than 5 minutes.  All I was doing was about 1/3 of my bedroom.  I mean really... that's how absurd it all was.  Basically the guy just wants NO NOISE at all, and in that case he should move to the country.

Every time I think of him, his voice, his disgustingly ugly face, his lanky body and his greasy unkempt hair I start to hurl.  I must harness this hate for future use.

I dunno.. I had a 40,000 watt PA system in the detached garage at my old house... sometimes I'd run it at around 130 dB SPL @ 100ft.... (to set the limiters)
I never got one complaint...
Just let 20 or so of your biker friends party at your house once a week and the neighbors will stay away.

If you can't do that, look up your county noise ordinance. There's usually a cutoff time for sound above a determined sound pressure level. Find the ordnance, and use it as ammunition.

I just took the trash out and when I walked by his apartment door I could hear one of those "white noise" machines running.  He must simply have sleep issues... like severe ones. 

I guess it's my fault that he has these problems.  Yes, yes... that's it.

My Opinion:
To answer your question, yes. It's a bit late in the evening. Would I vaccum around the bed at that hour? Yes. It's not much of an area.
So much of this depends on insulation factors of walls/doors/hallways, etc. But I have had a neighbor or two as you have now.
Seems they complained on the slight provocation because they mistakenly assume your disposition or consideration and tolerance is weakness.
Or, he/she has simply decided to have it in for you.

I had a an upstairs  retired neighbor who would decide to clean at 2am .  It was hell. Now I have a family who let there very young kids run around  at 10pm instead of being in bed - this is child abuse.
Yes you are wrong and you are breaking the law as well as having a tv to loud or other unnecessary noises. That is why there are leases you should read it.
Not everyone is on your late night schedule nor should they have to be. I find it bizarre that because some people are late nighters they feel it's okay to do what ever, with out any regard for anyone else.

This makes me laugh because  we all know if they woke you up in the middle of the night you'd be pissed.
Sorry to break it to you the world just doesn't revolve around when you feel like redecorating , hanging pictures, or redoing your bedroom.
Read your lease it tells when you can and can't do things, then apologize to your neighbor. . You are definitely in the wrong.

Tell him to move. I would love to move into a condo or townhouse but dont wanna risk living next to some one who is up late, beating their wife,has kids, are insane,or a hitman or whatever, so I guess I will stay in a detached structure. I have lived next to a hitman, above a guy who would beat his girlfriend all night long, next to a murderer out on parole, and several insane people. But more than that I hate when my wife starts the vacuum up on Sat morning.

Exactly what I was going to say and what I've done in the past, 'cept I laid my big old speakers (it was the '80's) down on the floor, 15" woofers pounding, and played the most offensive music I could find -The Violent Femmes.  They are still one of my favorite groups and are great in concert, by the way.  I did this a couple of times.  He then didn't complain about my vacuuming at 10:30 am! (he worked nights - so sorry!).

Excuse me, but when were people on "traditional" 9 - 5 schedules given special privileges?  What about someone who works midnight to 8AM and has to sleep during the day?  Shouldn't that person's needs be as valid as anyone's?   The graveyard shift worker doesn't have the right to demand complete silence when he/she is trying to sleep but asking neighbors to be considerate is reasonable.

The issue is excessive noise, at any time, is not appropriate.  I shared a shotgun double with a DJ whose speakers were always so loud our shared wall vibrated noticeably and it sounded as if the noise was in my apartment.  I called the police after unsuccessfully negotiating with him and they came out and threatened to cite him in the middle of the afternoon.

I frankly wonder what kind of walls there are in philly's building if a vacuum cleaner disturbs someone in an adjacent apartment.  His neighbor apparently uses a white noise machine (I just run the ac fan) and that is, to me, the route one should go if exterior noises are a problem.  Without the ac fan and a medicine chest of drugs I take each night to help me sleep I'd wake up several times every night.  As an urban dweller I know morons with deafening car speakers will drive by at 3AM or someone's car has a loud muffler or a fire or police siren can zip by at any time.  I've used background noise for years to drown out the everyday sounds of city living.

Oh, come on!!  One faggot calling another faggot is hardly gay-bashing, at least not in this instance.  You may not like the word in any context but just as some GLBT folks have taken epithets like queer, homo, sissy, dyke, and others and use them without pejorative denotations the word faggot has been adopted as well.   I may be wrong, and ask philly to correct me, but he'd used faggot to describe himself, in a non-derogatory way.  I'm a faggot, too. 

Words like faggot, nigger, cunt, etc. are unacceptable when used to demean others but if two Black kids call each other "Nigga" I don't believe they are doing so negatively.  They've taken a word used to oppress them and stripped it of negative significance, in defiance of those who still use such terms with historically racist meanings.   I describe myself as a sissy because I refuse to allow a word which denotes "acting like a woman" to be a negative trait, relegating everything female to a status inferior to male.  If a homophobe calls me a sissy I gladly bemuse the person by acting as if I've been complimented.

As far as my vacuuming I should have been clear -- I was NOT cleaning my entire apartment at 10:30 PM.  I was vacuuming out a stain that would have set from something I spilt, and the vacuum could not have been on longer than five minutes.

Now tell me who is in the wrong?  And I'll tell you where to take that lease and insert it.

Please come and vaccum my place too. I notice on Friday and Saturday nights, the noise cutoff seems to be closer to midnight. Personally, I try not to do too much after ten or so, but no one has ever complained.

My upstairs neighbors LOVE to start their Sunday Mornings at 9 AM with a vigorous vaccuming of their apartment. Never, ever fails to wake me up. I have considered a white noise machine myself, but figure a steady diet of Klonopin is just as good.

Have you considered a truce with your neighbor? I mean, knocking on his door, asking what solution he expects, and compromise? It sounds snarky, but I notice that the skittish and tempermental types respond well to someone paying attention to them.

Want to vacuum my house?  You can do it anytime!  Is a compromise possible?  Personally I don't think you did anything unreasonable and believe me I've been in those apartment buildings where sounds from every apartment can be heard through the whole building, but I'm someone who likes to at least try to live in peace.  Of course, some people cannot be pleased no matter what you do, but maybe trying to compromise might be a nice gesture.  And then if he is rude, then run the vaccuum, blast the stereo, and put the tv on full volume.

You won't like my answer, but 10:30 PM is just rude.  I get up at 5:00 AM and when I used to live in an apartment, I knew my neighbor worked nights so I did my household chores quietly and ran the dust buster around 3PM when I got home. 

I guess, I just care that people have different schedules even if some don't care that I have to be up early.  My former neighbor today - eight years later still comments on how thoughtful I was.  He too was kind enough to not run the washing machine at 12AM.

I guess you call it respect for each other.

Philly -

For pete's sake, tt was an emergency and required the vacuum.  Five freaking minutes to prevent a stain from forming in the carpet which would have cost you big bucks on move out!  The neighbor needs a life.  I am sure he's *never* done anything like that ever.  People like that need to be careful because comes around, goes around.   I am sure in the future, people will be less tolerant of his behaviour.

I live in a NYC apt building and just as a courtesy try not to cause too much noise after 10p or before 8a.  Yeah an emergency or something or other can come up on occasion but other than that no.  I also like you Nico talked to the neighbor downstairs whom I had never met because I run on my treadmill everyday and didn't want to bother him so I found out his schedule and only run on it when he isn't home.  I know I wouldn't want someones ass running on a treadmill right above me while I am trying to sleep.  Most people..if you talk to them first..appreciate it and are reasonable..but also their is an occasional jerk...Joe

I've written him a letter but haven't given it to him yet, and it raises these issues.  I need to buy a new ink cartridge for my printer first.

I still maintain in it though that's it not so much the complaints, though I see many as overbearing and quick to the draw considering I am generally VERY quiet, but more his tenor in pounding on the door.  Basically it's an issue of simply being uncivil WHILE he is complaining.
