I needed to get this out somehow.
My  husband and I purchased a home in October last year. The last home owners offered a home warranty with the sale of the home. So my husband mentioned that he wanted it. Our realtor also insisted that we should have it.
When signing at the title company the title company employees along with our realtor assured us we had full coverage on every appliance within our new home.
We called the home warranty company last December about the fridge, double ovens, and the dishwasher. They said their basic plan does not cover the fridge, they only covered the dishwasher, oven, and microwave.
My husband called our realtor and she said she would work on it. The next day our clothes machine continued through it's cycle as it was producing a burning rubber odor that filled our whole three bedroom home.
I called our realtor and she became very rude and said she was not an appliance repair person, it was not her problem, and she was working on it.
As it turned out all my husband and I knew was this other realtor who worked for the people who sold us our home really gave us the shaft.
Our realtor left my husband a text stating that she wanted to repair our fridge and then leave it at that. I replied to the text that I was really upset she ignored my complaint about the clothes washer and went behind my back to ask my husband to basically let her off the hook. I also threatened to get an attorney involved with the matter.
She kept trying to call my cell after that leaving all kinds of messages about her longtime upstanding service in the community and how people will not take our side and that no one can predict the future, things happen. I simply replied that even my husband feels we got the shaft, thanks for nothing, I can tell by the messages she does not care, and I am glad she got the commission from the sale of our home and I hope she had a nice life.
I refused to answer her after that.
Tonight on our way home the our realtor called my husband's cell. She said that she will cover the $120.00 to upgrade our home warranty to cover all of our appliances. She told my husband that she will use her own credit card to pay for it. Then mentioned how the other realtor made the error.
When we finally reached home my husband checked the mail and the home warranty company detailed list of plans came to us. Surprise, surprise our realtor's name was on it as the one who ordered the plan. We called the home warranty company and they confirmed it was our realtor who ordered the plan.
Our realtor had told us it was the realtor to the people who sold us the home who ordered.
So she lied to us! Just to keep $120.00 extra that really did not belong to her. And now we wait for a call from the realtor to make an appointment for us to sign a statement saying that we accept this home warranty plan and it is final.
I am calling an attorney tomorrow because I am going to meet with the realtor, take copies of what we are suppose to sign to the attorney before we sign, and see what the attorney says.
At the title company our realtor even kept the information with her name attached to it. Information we were suppose to have. Instead she wrote out the account number on the top of the ten page catalog and said we had a plan that covered everything. Now that I think of it, she never even said which plan we had either.

Im sorry you are having trouble with the fridge but I bet a lawyer will cost more than the cost of any repair you have done .

Idee , I recognize the Kafka like petty hell off these greedy amoral people. At the moment I am in week 7 off no kitchen due to many many people not doing there job. It now involves my member off Parliament , and while I was in hos my friend took over to advocate for me , do not give up ,stay calm , polite and lethal.

So, am I reading this correctly -- you got a FREE home warranty, but now want to hire a lawyer to save the cost of a washing machine repair??  As Jeff pointed out, the lawyer will probably cost more than the repair.
I can understand being upset if you feel like you were misled -- but this seems like a case of cutting off your nose to spite your face.

I do remember when I bought my house -- the home warranty that the seller bought only covered things that came with the house.  So, my refrigerator and washing machine would not have been covered, as the seller was only warrantying what she "left" in the house.

I would take a couple of deep breaths and really consider if it makes financial sense to pursue this legally.

When I bought my house I had a home shield policy and sure enough my dishwasher was dead as a cat on the highway . A repair man came and pushed a little reset button on the bottom of the machine and charged me a copay, it took all of 5 minutes and cost me $70 .

I still get offers 5 years later wanting me to renew that useless dog of a policy I let lapse .

First a disclaimer: I am friends with several realtors.

The name of the realtor on the home warranty may not be the one who actually ordered the warranty. If your realtor shares an office with others, the warranty order may have been delegated to someone else. Your realtor's name appears on the warranty because they were the one involved in the ownership transfer.

The most important thing right now is to get a definitive answer as to what appliances are covered -and which ones are not.

Then you need to decide if the $1200 upgrade is going to cover all the appliances -as you had originally been told.

Third, you need a competent appliance repair specialist to diagnose your current appliance issues.

Then take all this info to a lawyer. As others say here, it may cost you more to seek legal remedy than the remedy would provide. Still most lawyers will offer you an initial consultation free or cheaply.

I think your original realtor's attitude is poor and they're not thinking past the moment. My friends' business come mostly from referrals -and repeat business. You may have to remind her that, while you are new to the community, you and your husband have already developed a network. You will be relating your experience to everyone you know.
Reality is frequently inaccurate.
