NEW YORK -- The three men accused of attacking Michael Sandy will most likely face homicide charges after the grand jury convenes sometime next week, the Brooklyn District Attorney told NewChannel 4 Saturday afternoon.
Their alleged victim, Michael Sandy, 29, died Friday after his family decided to take him off life support, officials said.
Sandy's friends told NewsChannel 4 they were mourning his passing. They set up an impromptu memorial Saturday with flowers and paper signs outside his home in East Williamsburg.
The Gay and Lesbian Anti-Violence Project also planned to hold a rally at City Hall on Monday to draw attention to the issue of hate crimes against gay and lesbian people. Project organizers said there are on average 60 such crimes a year in New York City.
Sandy had been in critical condition at Brookdale University Hospital and Medical Center after running into traffic on the Belt Parkway on Sunday evening. He had been trying to escape the attackers, police said.
"Michael ... had a bright future ahead of him," Mayor Michael Bloomberg said in a statement. "That future has been taken away by a group who apparently had a pernicious scheme to single him out because of his sexual orientation, lure him to a desolate area, and rob him."
Three young men have so far been charged with hate crimes in the assault and robbery of Sandy, a gay man investigators believed was lured over the Internet, with the promise of a sexual encounter, to Plum Beach in Sheepshead Bay, NewsChannel 4 reported.
Instead, when he arrived, he was beaten, then ran onto the Belt Parkway to escape where he was struck by a car, NewsChannel 4 said.
Gary Timmins, 16, John Fox, 19, and Ilya Shurov, 20, were all being held without bail after being arraigned earlier this week.
According to a police commander who spoke to The Associated Press on condition of anonymity Wednesday, one of four men questioned by police had met the victim and convinced him to drive to an isolated parking lot near Sheepshead Bay in Brooklyn where a group was waiting.
The confrontation eventually spilled onto the busy parkway, where the victim was hit by a vehicle.
The men questioned said they were heterosexual and indicated they had in the past used the Internet to lure and attack gay men, the official said.
Police were also searching for the vehicle that hit Sandy. The driver did not stop at the scene.
The crime has outraged many, including Christine Quinn, the city's first openly gay council member and speaker.
"I join all New Yorkers in condemning this hateful and horrific crime," Quinn said in a statement. "Michael Sandy's death is a tragic reminder that we must continue to work hard to make intolerance and discrimination unacceptable in our City."
A spokesman with the Brooklyn District Attorney's office said Friday night it's likely prosecutors will file homicide charges against the three young men.
Quinn said she expects "the district attorney's office to act aggressively and expeditiously to prosecute this case to the fullest extent of the New York State Hate Crimes and other relevant laws."

Singer Kevin Aviance beaten in New York

NEW YORK -- A singer suffered a broken jaw and other injuries in an attack by a group yelling anti-gay slurs, yet he hopes to perform again by the end of the month, police and his publicist said.
Kevin Aviance, 38, whose songs have topped the Billboard dance chart, is expected to be released Monday from the hospital where he underwent surgery, publicist Len Evans said.
Four people were arrested on hate-crime charges, police said.
Aviance's jaw is wired shut, but he hopes to perform in the city's Gay Pride parade at the end of the month, Evans said. The agent had said earlier that Aviance would not be able to sing at the event.
"He's going to try to get his strength back so that he can perform," he said.
Aviance's song "Alive" hit the top of the chart in 2002. His other popular songs have included "Give It Up," released in 2004, and "Din Da Da," which topped the Billboard dance chart in 1997.
A group of six or seven males attacked the singer early Saturday on a corner in Manhattan's East Village, Evans said. There were passers-by, but no one stopped to help as the attackers threw objects at him, Evans said.
Aviance performs in drag but was "dressed like a boy" when he was attacked, Evans said.
The four people arrested ranged in age from 16 to 20.

I thought NY was more forward than this. That sounds like the kinda crap you would hear about here in N.C.
What a sad commentary on our society.
I hope all three of them are charged, and tried as adults, and the D.A. tries it as a capital case.

It is a sad, sad situation which is not happening only in NYC.  The same pattern of hate crimes is now making a coming back in Paris as well!

It makes me sick to see people hurting others just because they choose to live a different life style.  I hope that these people get put down for the rest of their natural lives and that they live a very long time in prison, so that they can think about what they did.  You would think that people would be more tolerant of others.  It is just sickening.

 These are the values laid down by American society so it isn't hard to grasp. For one thing when you have a society treating you like a second class citizen it is easy for the younger members to push the envelope.
What never happens in America is the onus on the parents who created these criminals. In fact they are the ones always standing up and telling us how great they are. I think since in America one doesn't become an adult till 21, the parents should also be forced into some sort of punishment. This would force parents to be more involved with the children.
