After 3 years of sorting my head out after diagnosis got offered a great job 2 months ago, in a nursing home as their group quality control manager. They knew my status and seemed OK about it. 5 days in I catch a bug that they were aware was going round, which develops into pneumonia. 1 week in hospital, 2 weeks off sick, start meds. Back to work. 4 days in I develop stevens-johnson syndrome, back into hospital, now off sick again. They are refusing to pay me SSP, saying I'll have to wait til I go back to work. despite never being able to get my boss by phone she now refuses to communicate by email or txt. I have txts saying they will keep my job open but they have not paid me properly at all and are asking me to justify my being given a permanent position. How can I when I've not been there? all the time I was in hospital, I was trying to recuit staff, giving out brochures, recommending our homes, and I have the txts to prove it. I have done everything asked of me and more and yet they seem to think they can get away without paying me, and are starting to infer that I won't be offered the job permanently. I'm suffering really bad side effects from kaletra, as I'm having to 'double dose' at the moment, and the stress is exacerbating the stomach problems. I think part of it is that my female boss told me at interview that she understands my 'problem' as she has Hep C. since then, she has decided to try the chemo treatment route and everyone thinks she has cancer, I'm the only one who knows otherwise. Am I being paranoid here or am I being pushed out? Has anyone any ideas? I've got a med cert for two more weeks and need a plan. I WON'T resign, coz I think thats what they want. Thanks..really am trying not to whine but this is driving me NUTS!

I'm sorry to hear about your problems Tigger and I hope that your health soon improves.

Are you in a union?? It looks very much to me that you're right and they're trying to push you out. If you're not in a union I would contact a solicitor without delay and certainly before having any further contact with work, preferably one specialising in employment law. The Law Society, your local Citizens Advice Bureau or a Google search should point you to one in your area, the first consultation should be free.

I am certain that your employer has a legal duty to pay you Statutory Sick Pay after the first three days of illness and where a second period of illness occurs within eight weeks the two claims for SSP can be linked into one. I am also sure that this comes into effect from the time of your employment starting.

I think that you have to try to decide whether or not you want to continue to work for them, if you do then a mediator could help to iron out the problems. If not then, as a layman I think you possibly have a case for claiming constructive dismissal, or maybe Disability discrimination. I presume that you've not received a contract of employment yet but don't let that put you off at least talking to someone qualified to give you proper advice.

Thanks for the info.and supprt, its appreciated.They have now given me notice on the grounds that I haven't proved myself, (was off), and 'haven't sustained robust relationships with other staff', ditto. My boss is trying to guilt trip me, saying she is trying to build up HER immune system for surgery...and heres me thinking my CD4 count of 26 was trivial!! Am going to get in touch with THT monday. She has lied, dropped herself in it with emails saying what a great job I'm doing and effectively built my case for me. trouble is, do I want to become a cause celebre? The UK press would love this. also my consultant has expressed her worries about the stress a court case will cause me. All I want is the pay I'm due and a proper chance. my health is more important but who the hell do these people think they are? Yours, broke and getting broker because of hideous bank charges because I've not been paid!

Hi Jo, and thanks for the update.

Please do make your appointment with THT and pursue it at least that far.

I can understand your reluctance not to have all of this dragged into the public arena and of course your health must come first above all else. My guess is, that if they think that you're going to fight they'll cave in before it gets to that stage, particularly if they're a larger company. I make this assumption, (a pretty large one admittedly), on the basis that they have at least admitted that you were in fact employed by them by giving you notice of dismissal, also being in the health care field will they really want a claim like this to be made public? They already knew of your status and I think that they might find it hard to defend a Disability discrimination claim. I am certain though that THT will advise you with more certainty.

Like I said "your health must come first", but; won't it still be stressful knowing that they've just walked all over you and won? I know I'd be as mad as hell. Obviously you'll need to give it some careful thought.

If they've refused to give you SSP then the DSS should process your claim (PDQ, I hope), again the THT will advise you better.

I'm spitting feathers!! My boss has just sent me an email saying that any wages due 'will have to wait' as she has 'taken a week off work to boost her immune ststem before surgery'! Is this just taking the piss or what? If she wanted to make me angry she's succeeded, now don't give a damn what bad publicity ensues! Have had relatives of residents ringing to see where I am and have a fine collection of emails and txts saying what a great job I'm doing, I'm going to BURY them. They're not one of the biggest residential nursing care providers but they are one of the more wealthy and I'm so going to enjoy relieving them of a not inconsiderable amount. am going to get in touch with THT in AM and get a brief. (Bitter twisted and pissed off I may be but I adored the job and its hard to have hope given to you and then torn away. Not done a lot for my self esteem).
