What's upsetting to me is that, according to the article, our current Administration thinks DOMA is unconstitutional but will continue enforcing it. And they're going to look at things on a case-by-case basis? They better get on this case pronto. Time is running out. Hopefully HRC will get wind of this. They have a way of getting the word out.

This is a clear example of why the Obama administrations stance to enforce but not defend DOMA doesn't go far enough.  They should be actively advocating it repeal.

For anyone who might be inclined there is a petition circulating to ask the government to please intervene and ' stop the deportation'

While adding the voices of a few thousand petitioners on their behalf couldn't hurt there was some good news on this front yesterday afternoon --

UPDATE: On Tuesday afternoon, Anthony John Makk and Bradford Wells announced that they will be appealing their Defense of Marriage Act visa denial, as reported by SF Weekly. SF Weekly also reported that Nancy Pelosi has reached out to urge the Obama administration to reconsider the decision. Her office released the following statement: "Leader Pelosi has formally contacted USCIS on behalf of her constituents and will be working to exhaust all appropriate immigration remedies that are currently open to pursue."

Here's an interview with the couple.  The American is a PWA with, evidently, some serious medical issues.  His HIV-negative husband is from Australia.

Even if he weren't anyone's husband, he's lived here for nineteen years.  Someone who's managed to live that long in one place should be allowed to stay.

I wish everyone thinks the way you do. I have been living here in US almost 15 years legally. After my sponsorship goes through, it will be almost 18-20 years of me living here. Guess what, I don't have any right to say anything (after spending years- golden days my twenties and thirties). Even though I believe I have earned some kind of right after paying my own share of taxes, Nope. No matter what we say on here unless marriage issue becomes into a law, nothing matters. So, I am hoping this case goes all the way. IT IS TIME. Federal law needs to reflect the equality! State laws only works for states. Federal laws take care of Marriage, Immigration. Unless, Federal law accepts equality between Man and Man (gay/lesbian) companionship, families will be broken and there is nothing anyone can do about it. Very sad news. We gays are not any less human than straights! Nineteen years!!! Talk about a lifetime and Think about one of them is POZ who relies on the other’s supports. This case should be model for gays to have the equality rights in USA among Gays. I believe USA is the only country in the developed world where the Government lacks the ability to provide the equal rights in Federal level as far as marriage concerns..

They were supposed to have filed an appeal which should but them some time.

There is also some hope that once actual deportation proceedings have begun they may be eligible for a
reprieve under the Obama Administrations latest interpretation of the law.

It's too bad that at the same time some couples are being granted reprieves they are still having to battle it out.

I would be the happiest guy in the world if they win and the law favors the multinational marriage equality among same sex couple in USA. Thanks for sharing edfu!

Rep. Pelosi has helped to obtain a partial victory.  The couple has received a two-year stay against the threat of deportation.  Great news...for now.
