Good Evening Folks,

I know the Queen says she doesn't like to bitch but I have been catching pure hell or at least that is how it feels to me. In another thread, I had mentioned issues that my friend is having, that was on Monday, and I was stressed enough about that. Here comes Tuesday, which I thought was going to be a good day, was I ever WRONG! I got into a car accident!!!!!! My first one ever....Now the shit hits the fan.

I had a stop sign and I stopped. I know I did because on this street and the way I was coming every block has a stop sign. Also because I had paused at the stop sign to put out a cigarette. I looked both ways and proceeded to go and out of no where......SMACK!!! By a Ford F-150 who was doing more than 25 in a residential zone and from where the damage is to my car. It took the police 30-45 minutes to show up. So, when he did, I gave him my information and explained that I needed to leave cause I had something on the stove at home. The guy in the Ford and the cop must've had a helluva conversation when I left because when I went to the police station to get a copy of the police report, it has me listed as running a stop sign? WTF? This cop never asked me what happened, never looked at the damage to my car, he just was trying to get the stop sign from under my car. This Ford hit me so hard that I ended on top of the stop sign. I have damage to the rear corner panel of my car, the rim on my back tire is bent and metal is slowly cutting into my tire.

In my eyes there is no way I ran the stop sign, if I did, the damage should be to the front of my car. The Ford has very little damage. I went to the hospital, I have a concussion and an acute cervical strain. That is the reason you guys haven't seen me in a few days. The doctor told me it was because of me having a older metal car that I'm still here cause if it was any other car, I would probably be dead.

The thing that is funny to me is that the man in the Ford never called the insurance company and on the police report his family are witnesses? How is that even possible? Of course they are going to side with him. One witness did come forward on my behalf. But I am pretty much screwed, I had insurance but only coverage to cover damage to the other car and not my own. So, I am trying to go after him despite what the police report says. But what is weird is neither insurance company has requested the police report yet and neither has asked about taking pictures of the damage. Do they not do this? I did take pictures of the damage on my cell phone. The adjuster for guy's insurance hasn't even bothered to call me at all. My insurance company called and asked for my version of the story and I gave them the witness's name and phone number.

I have been in tears most of today because of what the police report is saying and I need a car. The damage is so bad and my car is or was a 22 yr old car, it will not be the same after a hit like that. I wish I could show you guys the pictures I took. I can't drive it because the metal is cutting into the back tire and my car is on a tilt like I got hydrolics or some shit. Without a car, I can't go to doctor appointments or grocery shopping..Yeah I know that you are saying have someone take me.....there is no one to take me.

Because of the accident, I missed my doc appointment with the ID doc but has to get blood drawn on the 21st and he's gonna see how that goes. I went to my primary doctor today, I have to get xrays done of my neck but how am I gonna get there? My right ear is infected and has fluid in it so he gave me some more ear drops and is going to refer me back to the ENT doctor.

Maybe now, you see why I called the topic what I did. I know I should be glad to be alive but I am also very disgusted because I can't understand why bad shit is happening to me.. I am open to any suggestions you guys might have about the accident, this is all new to me and I really don't know how to proceed. I'm thinking I may have to sue him on Judge Judy or some civil court. :'( :'( :'( :'( :'(

Stick to your story. You did not sign a police report. Your insurance will fight it. You need to file a small claims court immediately. In California, this is up to five thousand dollars and costs very little money to do it. Your next option is to go to an ambulance chaser immediately, and start your documentation of what happened. It is a good thing you have a witness. Bad shit happens all the time. I got two tickets in one week. I let one of the tickets lapse and it doubled to one hundred forty bucks. Life sucks sometimes. I feel your pain.

I know the laws very from state to state but it sounds like you might have to end up in court. Good luck, and I'm glad you or no one else was hurt.

No, I never signed a police report nor did he ask me what happened. I'm hoping my insurance will fight it but in the meantime I will be getting a citation mailed to me, WTF? But my question is why he never filed? I thought a person had 24 hours to do so? And why is no one trying to see the damage? I think the police report screwed me with trying to get his insurance company to pay for another car, so is my only option is civil court, I will have to find out how much that costs. I did call one lawyer here and they told me because they have me listed first on the police report that automatically puts me at fault. I told my insurance company this and they said they never heard of something like that. The only reason my info came first is because I handed it to him first. I also think there is something dirty going on because I really didn't know what to do. I asked the cop what was procedure and he told me to call both insurance companies.

Thanks Auntie Doxie. I feel I was blessed to walk away from that one with the injuries I have.

No. What I said to the cop was that I didn't see the truck, it came from no where. What the guy and his family kept saying is that I ran the stop sign. And if I had insurance, they acted like I was gonna flee the scene, just kinda of a typical racial thing to me cause I'm black. I also told the cop that I needed to leave cause I had something on the stove at home, I think they might try to use that against me.

Thank god you weren't seriously hurt.  That is the most important thing.  

Not to piss on anyone's "go girl" parade, but I gotta be honest with you sweetheart.

If I understand correctly, you had the stop sign and the F150 didn't.  (Was it a 4 way stop?).

That means the F150 had the right-of-way.  It isn't likely going to matter where you were hit, how hard your were hit (unless you can prove with certainty speed was an issue), or what has happened since the accident (the mention of 24 hours to file, view damage, etc.)

Unfortunately, (meaning the issue of right-of-way) that's going to be the bottom line in deciding liability in this situation.  Your insurance company isn't likely to fight it given the circumstances.


The one thing you might be able to successfully argue is the citation for running a stop sign.  Although I don't know if "failure to yield" vs "running a stop sign" is much different in terms of fines.

My thought is to be thankful you weren't seriously injured, try your best to get different transportation, and forget about "hiring a lawyer".

HI Queen, wow, sure sucks.  You're definitely going to have to fight the stop sign ticket in court.  Based on how you describe your damage, I would think you were well into the intersection when the truck hit you. Alot depends on skid marks ( or lack of ) from him braking. You should get out to that intersection and take more pictures . I'm thinking you should contact a few more attorneys for more opinions. If you can ,get one to take it on contingency, so you have no out of pocket costs.

WHen you go to court, it was a Crock-pot. You got that?! ;)

BTW, if you were able to drive the car home, get some hunky neighbor guys to pull the metal away from your tire so you can drive the car ( if it's still driveable otherwise)

I value your opinion even though you don't think I have a chance in hell. It was a 2 way stop sign, I stopped at the sign because I had put out a ciggie. If I had ran the sign, the damage should be to the front of my car, that is what is making me fiight this more than anything. He had to be going more than 25 mph for the damage to my car. And if I would've ran the stop sign and he was going 25mph he should've been able to stop before hitting me.

There were not skid marks, which would make sense because I did not see the car coming so I was moving forward. The stop sign was also fixed as well, the only thing I have is a witness, to me that should count for something. I am going to call another lawyer on Monday. A friend of mine suggested going to a State Representative to fight it also but am not sure what good that would do. I'm thinking this metal cutting into my tire in from under the car somewhere. The car can move but it is not driveable, it is slightly on a tilt.  The rim is also bent to my tire and the tire is now warped. I'm going to my mechanic to get an estimate from him or if the car needs to be totalled. I think the guy who hit me and the cop are taking advantage of the fact that I did not know what to do on a accident scene.

NO, you read something wrong. He didn't have a stop sign, I did. It was a 2 way stop but he had to be doing more than 25 mph because if he wasn't he should've been able to stop before hitting me. If I had ran it, the damage should be to the front of my car and the front passenger door instead of the back door and the rear corner panel and a bent tire rim...Follow me?

the chain of events and to make you the fall guy.  I know its too late now but never leave the scene of an accident....not until the police get
there and file the report.  At this point let me suggest you contact your local Legal Aid and see if you can get some legal advice....Can your
local ASO help out with this????  You may have to camp out at the police station to get a sargeant or someone in charge to listen to your
story and perhaps take you seriously....however keep in mind they're going to give you a hard time for leaving the scene of an accident....

The important thing is that you were not seriously hurt. Those trucks are big, and sit so much higher than a car. It could have been worse.

In regards to having a way to the doctor, call your local ASO and ask if they can provide a ride to the Doctor and grocery store. Also, is there a local People mover van in your area? Call the Agency of Aging. Look in the blue pages of the phone book. My grandmother used them to get rides to the grocery store, pharmacy, etc. I think they also provide rides for people on disability or with illnesses.

Do you belong to a church or is there a church near you? Again, call and ask if there are any members who volunteer to help drive people.

Ask for help. I think from reading your posts, you don't like asking for help, and would rather solve the problem yourself. I know, I am the same way. I hate asking people for help. But sometimes, you just need to ask.

As far as the insurance/ police report. Call the State department of Insurance, and ask them their opinions on what happened.

I think it might be a hard case for you to fight. Even if he was speeding, you had the stop sign, plus then you left the scene of the accident. Not saying you should not try to fight it, just realize it might be difficult and stressful. If you do decide to fight it, document everything. Every phone call, keep all your records.

Hang in there. You will get through this. It is just going to be hard for awhile. Know that it will get better.

Ok, to answer some of your questions...I told the cop that I had something on the stove at home. Yes, I know the accident was major but did not want to come home to the fire dept being in my building and at my apt. The cop never asked my side of the story. Yes, the car can move, but I do not consider it driveable as I said before metal from the hit is rubbing my back tire. And the cop was there long enough to ask me this since he was trying to get the stop sign from under my car.

I did not have a phone to call an ambulance and at the time was not hurting, that happened hours later. Why would I have to go to the police station? I went on Friday to the police station to get the police report and at that time neither insurance company had requested it yet. The reason I went on Friday is because I couldn't report to his company until Wednesday because they were closed on Tuesday. Thursday I was being dizzy and throwing up all over the place which I feel is from the concussion.

The important thing is that you were not seriously hurt. Those trucks are big, and sit so much higher than a car. It could have been worse.

In regards to having a way to the doctor, call your local ASO and ask if they can provide a ride to the Doctor and grocery store. Also, is there a local People mover van in your area? Call the Agency of Aging. Look in the blue pages of the phone book. My grandmother used them to get rides to the grocery store, pharmacy, etc. I think they also provide rides for people on disability or with illnesses.

Do you belong to a church or is there a church near you? Again, call and ask if there are any members who volunteer to help drive people.

Ask for help. I think from reading your posts, you don't like asking for help, and would rather solve the problem yourself. I know, I am the same way. I hate asking people for help. But sometimes, you just need to ask.

As far as the insurance/ police report. Call the State department of Insurance, and ask them their opinions on what happened.

I think it might be a hard case for you to fight. Even if he was speeding, you had the stop sign, plus then you left the scene of the accident. Not saying you should not try to fight it, just realize it might be difficult and stressful. If you do decide to fight it, document everything. Every phone call, keep all your records.

Hang in there. You will get through this. It is just going to be hard for awhile. Know that it will get better.

Yes, I did have the stop sign and when I stopped and looked both ways I did not see him. I'm getting the feeling that the damage to my car and where it is located should prove my case....I'm not understanding why folks here think that doesn't matter? I am going to fight it. But here is an update, someone on Saturday tried to rip the front bumper off my car, isolated incident, I think not, and there is white paint where it was pulled from. I know in my mind that the guy I got in the accident is behind this but I can't prove it. It was not a hit and run because there is no other damage to the front of the car.

And you are right, I really don't like to ask for help. I will check into the legal aid and had planned on calling some lawyers. As I said, I believe I am being taken advantage of by the other driver and the cop because I didn't know what to do in case of an accident. I only got my license 2 years ago and that is how long I had my car.

I don't think it would reach a jury here. I got the citation today whether to plead guilty or not but the citation says that if you plead not guilty you still have to pay fines, I'm not understanding this, if I feel I am not guilty then why would I have to pay anything?

Just an update on things..

I haven't been on much lately cause things have been kinda rough. I have been throwing up like crazy for the past few days. I think this is a result of the accident but the xrays are coming up good, had xrays of neck and head. I was looking over the citation they gave me. I do have a question if anyone wants to give their 2 cents. On the citation it has my information on it but for the model of my car, it has an Impala and my car is a Caprice Classic, there is a difference, ya know.

I plead not guilty to the citation. I have a witness who came forward a few days after the accident but when she called the police station, they told her she couldn't be a witness, wtf? Then 4 days after the accident, someone comes along and tries to rip the bumper off my car. I know it was the guy from the accident cause if another car had hit me, it would be damage to the quarter panel in the front.

I am trying to find a lawyer to take the case. I am waiting for a call back.
