Getting used as an example of the high cost of health care...

  Next month my company holds its annual meeting to discuss changes to our health care plan, and I am already dreading it.   
  Every year, our health care provider brings along a slide show presentation that lays out the costs of the prior year etc.   And once again, I am sure that my drug regimen will be the top 3 listed in the "top ten perscribed drugs" for our company.  Even though my name isn't listed next to Truvada, Kaletra, etc. it might as well be.  My company has only about 30 employees and it becomes a guessing game among them, to determine who has what ailment by this "top ten" list.  "Someone among us has HIV!"  "Someone has Cancer!"  "OMG, someone has Hepatitis!"
  I am forced into the closet at work because I can still be fired for being gay (don't ask, don't tell) but my closet has a glass door.  I am the only "unmarried" man in my department.  I am in my 40's and have a long time male "roomate".  And even though I am fairly goodlooking I never seem to have a date at any company functions.  (I wonder who could be HIV+)
  Thanks for letting me vent...  The baggage of my dirty little secrets gets heavy at times.

That is reprehensible that the HC provider does that!!!  In my position I would NEVER bring drug names no matter how big the company was. 

Is there any way that you can talk to your HR Manager about this practice??  Saying the drug names in this day and age is almost like waving the "Guess Who Has What?" flag and that is SO against HIPAA. 

They are in a round about way releasing your medical information to the public without your consent since it is in a public forum with 30 other employees.  If it was in a large above 200 company I can see that playing the guessing game would be hard but my God!  You have 30 co-workers!  It is easy to narrow this down.  This practice has to stop!

I don't think your employer can fire you for being Gay and Having HIV, if they do, they would have a BIG ASS LAW SUIT on there hands ,and most Companies don't want that type of Publicity  if they even tried to get rid of you, and you got an attorney, in the end of all of this you would be a Millionaire........

Its deplorable that such information is made public. I can't imagine this is legal... Even if no one is named to go with each treatment, it must be some kind of illegal invasion of privacy. I've never heard of such a thing. Why do you all put up with it??

By the by, even if they have all figured out you are gay, doesn't 100% mean its you who is HIV+. Lots of straights get HIV, too... Most people would jump to the conclusion its you, however, I give you that....

I would seriously ask around some labor lawyers or something to see if this treatment disclosure is legal.

  It's very unethical to say the least (perhaps illegal).  That is why I've kept the last two presentations on file, in case I need them in the future.
  They not only list the drug, they list the use and the monthly cost.  For example, Truvada (Antiviral) cost of 30 day supply $839.16.  They also present a list of "top ten injectables", their use and their cost.  The way that they are listed seem much more telling.  Pegasys (Hepatitis) $1874.68.
  I am supprised that I am the only one in my company that seems to have a problem with this.   I am also afraid that if I protest "the list" it would confirm any suspicions about my HIV status.  I am, at least, going to speak with my HR director and voice my concern.

  I am ex military, but my company is not the military.  Just another homophobic company in another homophobic state, where you can legally be fired for what you do in your bedroom.

Your Company must comply with HIPAA.  It establishes regulations for the use and disclosure of Protected Health Information (PHI). PHI is any information about health status, provision of health care, or payment for health care. etc that can be linked to an individual.  This includes Medical Administration Records which include drug prescriptions and dosages. 

Since your Company is very small, it is too easy for co-workers to disseminate your name and condition which in turns has grossly violated HIPAA.
