Where to get help from?

Hi everyone. I have been living in the Uk for the last 9 years and I have known my HIV status for the last 3-4 years and have been recieving treatment for 2 years. (Iam from Zimbabwe) I was a student and was still unsure about going to Uni or wait till I reach 10yrs and then go to Uni at a reduced rate. My college was removed from the new Home Office removed list and I have just been given less than 7 days to leave the country which I have now overstayed by.

After having been in the UK and getting treatment easily and you are told you have to leave within 7days. How can you imagine having to go into a country that you have not been for 9 years and where the healthcare system that is totally collapsed can be the most difficult thing inlife. My time has been spent trying to organise medicines for myself when I get back and also trying to see if I can extend my stay.

I have turned to every charity here in the UK tying to get advice but all seems to be failing.  I dont know here to turn to and all the solicitors I have sought help from have said that there is no chances of getting Discretionary leave or Asylum in the UK because my CD4 count is very good and I would be able to recieve treatment in my home country.

1) I would like to know if there is anywhere I can turn for help to get my stay extended.

2) I would also like to know if its possible. I would like to start a programme or initiative other HIV positive people abroad where they can pay some money into an account or scheme so that when they return to their home countries they can recieve treatment for at least a year whilst they sort out other alternatives.

3) Is there any type of life insurance policies for people with HIV?

Hi Domike, welcome to the forums.

I don't know what to tell you. I'm sorta in the UK (Isle of Man) and it sounds like you've already approached the people I would suggest you go to for help.

If being here is dependant on being a student, can't you try to get into a different school?

When you say you went to charities, do you mean places like THT, and did you speak to people in their asylum departments?

If your solicitors have told you that you cannot get asylum because you can get treatment back home, will this change if you prove that you cannot get treatment?

Thanks for the reply.

I have been to THT but I have not managed to speak to anyone all they can provide is info on where to get treatment from when back in Zimbabwe.

I have tried enrolling to other colleges but the HomeOffice has kept my passport so none of the colleges are interested in taking me on as this can lead to countless investigations so they dont want to know about my case. The only colleges I have found that can take me on are requesting £4500 - £9000 upfront which I cannot afford and even if I could if my visa appeal fails I will loose it.

All the solicitors I have seen said I can take the Asylum or discretionaty leave route but it will be hard as I have been studying and stayed in the country legally. All the solicitors again want a lot of money so I m really stranded dont where to start, whether to look for treatment back home when I am still here or whether to stick to trying to get legal advice here in the UK.

I'm sorry about your wretched situation. I think you're going to have to rely on the mercy of the UK government to allow you to stay.

I'm not an migration law specialist, but I think unless you can demonstrate you have a well founded fear of persecution back in Zim, asylum might be difficult to swing. Particularly as many western governments are taking the view that things have settled down back there since Tsvangirai became Prime Minister.

I agree with Ann. You need to speak to a lawyer.

Welcome to the forums Mike'

Have you tried seeking asylum on humanitarian grounds..under human rights you can not be deported back to zim in your situation despite how good your CD4 count is.  Many people have tried this and some have been success in getting compassionate leave to remain in the country on medical grounds. Another alternative is contacting your MP, who can write directly to home office informing them of your situation. The MP can influence the home office to change their stance.  People have done this again and again some have been successful eg my 2 friends from Zim have had their deportation repealed.
As Ann suggested charities like tht and nat are advocating for equality of opportunities for immigrants/asylum seekers to be treated regardless and that they should not be deported back to their countries.  For this reason it is worth contacting them again

I don't think there is any way around it other than speaking to a lawyer. This UK residency forum may be of some help, it was for me when I was preparing information for my ex-partners application. His was different circumstances so i'm unable to help, but someone on there may have had similar experience to you and there are also Immigration consultants there that will answer questions.

Thanks. I will have to join the ukresidentforum again because I put a post there when it was still free but I didnt get any replies and when I tried to enter a new post again they had started charging. I will try THT and NAT again.
