Hi,
may be i am becoming to sensitive to what people are saying and doing. So i thought i would ask for an objective opinion from the forum.
As a quick back ground, I caught HIV from a female at work. She went on to infect several other persons. I got ill and diagnosised with HIV. I made a complaint against my work collegue to the manager, who was not sympathetic at all. then my medical notes were accessed by work collegue who had nothing to do with my care. (i am in the health busness). the contents were gossiped and spread. I was made to be look like the villian as i was off work, the culprites are still working.
so i requested a transfer, it was denied on the basis that the area where i wanted to work had no vacancies, no one was off work sick, there was no need for relief cover and they did not use casual or agency staff (read perfect team!) i was told i would have to wait. so i did. i have waited 5 months and still there is no need for me. no work, not even for just 7 hours a week.
now work has turned round and said that i should accept a payout. if i accept the payout i can not work in any government position again for 3 years. the amount of the payout would be the same as 3 months salary. there is no other work that i can fall back on.
the reason for the payout is that work now see's me as a liability as i may make a claim for bullying/stress or what ever in the future. i reminded them that if i had a bad back they would allow me to work, although i may make additonal claims in the future! it was wispered to me that i have made people upset due to the nature of the complaint and they want to squeeze me out.
so what should i do, oh i have a lawyer and they have asked me what do i want to do, bearing in mind the department i work for are not willing to transfer me.
what would you do in this situation, oh just to compound the issue i have a partner and two children under the age of 3, so upping sticks and moving is not really on the cards. :o am i being paranoid or is there some kind of predjudice here?

I am sorry to hear the stress you're experiencing.  As I understand it, you were hooking up with a fellow co-worker.  You believe you contracted HIV from her.  How do you know this?  How do you know she infected several other people?  If you went to your superiors to tell them she infected you, I could understand how they would feel that was none of their concern.  Employers cannot be responsible for what happens in the personal lives of employees.  I mean, some employers have rules about supervisors/managers dating subordinates.  I am just saying I could see how they wouldn't view this as an HR issue. 

I was confused by working in a hospital, and not being able to work in the government for three years, if you take the payout.  Is this a VA hospital?  That part is confusing.  Can you be more specific about what your complaint was, and what you thought your employer should do?  If I had an affair with a co-worker, and contracted a virus, I don't think they would want to hear about it.  Again, unless this person was a manager. 

About viewing your health records, that is a violation, if they had no reason to do so.  I would think most computer systems would be able to tell who accessed your records.  If they did not have clearance to do so, then that is something that should definitely be handled by HR.  I know many health offices and hospitals now take this very seriously.

If I am not understanding your situation, I apologize.  From what I think I understand, you believe this co-worker knew her status and you want managers to discipline her for not telling you??
