Yes. It is low risk but the risk remains.

there is no cure for HIV so even though your VL may be undetectable, you will still remain HIV positive.

What spacebar said, but the risk is HUGELY reduced.

Once HIV positive you will always be HIV positive. It's what the body does, produce antibodies to alien invaders. They tend to hang around, antibodies, on a once bitten, twice defended principle. Antibodies are useful (except with HIV when wanting to emigrate to selected countries requiring an HIV negative antibody test  for residency :-( )

Also, aren't viral loads somewhat variable depending on the time of day just like your CD4?  I don't know how much the variance would be, but. . .

If you are HIV positive and you and/or your partner isn't practicing safe sex, have you not learned anything?

Not passing judgement, but I found your question to be strange.
04/19/11 - Diagnosed positive
04/29/11 - CD4 188 @ 12.5% / VL 18k
05/03/11 - CD4 171 @ unk% / VL 7k
06/04/11 - Start Truvada/Isentress
07/11/11 - CD4 not tested / VL UD
09/07/11 - CD4 252 @ unk% / VL UD

Not like absolute CD4 counts. But tis true 2 viral load draws an hour apart, or even at the same time, will give different numbers. The margin of error of the test is 1 log (from 3 x the number you get from the doc to 1/3rd).

Sorry if this question sounds silly, but would the Berlin patient (the only one to be functionally cured)- still test positive on an HIV test?  Not that it makes a difference to any of us, but I'm curious.

Until his body no longer generates antibodies to HIV yes.  This could take a while.
