The Supreme Court of Canada has ruled that some people with low levels of HIV who use condoms during sex do not need to disclose their condition to sexual partners.

In a 9-0 ruling, the top court updated a landmark 1998 decision that made it a crime for HIV carriers to not reveal their status.

Critics of a 1998 Supreme Court ruling on HIV disclosure pointed to evidence suggesting people who take anti-retroviral medication and use condoms have almost no risk of passing on the virus. (Adrian Wyld/Canadian Press)
The court ruled Friday that HIV-carriers must be on anti-retroviral medication — and they must use a condom. Otherwise, they have to disclose their status.

Under the previous law, HIV-carriers who didn't tell partners they had the virus could be charged with aggravated sexual assault. The maximum penalty is life in jail.

I am from Canada, I am happy to hear about this ruling. It's a step in the right direction. I really need to learn not to read peoples comments at the bottom of these articles, they always make me angry. It amazes me how many people put the responsibility of their own health in someone else's hand.

Couldn't agree more, JF. The comments are so complicated and nuanced and show little if any evidence of the kind of social awareness/responsibility that I would wish for this rock.

I agree, too.
And those comments are awful. The sad truth is that with these attitudes of people and laws criminalizing HIV it's really no wonder that some people refuse to get tested.

Please correct me if I am wrong but as far as I am aware there has never been a documented case of HIV transmission from someone who is UD and used a condom.
