I have a friend who was accused of something similar back in FL.  He was from AZ, but now lives somewhere else.  The other person involved would go out to the bars and drink to excess 5-6 nights per week, and also be with other persons.  His issue occurred nearly 15 years ago.  His name has since been searched on NCIC by other agencies, and he does not have a warrant.  I told him that if this amount of tme has elapsed and nothing, he is safe.  He also adamantly claims he did not have intercourse with the person.  I have recently told him that FL law states that intercourse is stated as between a male and a female; therefore, same sex couple cases have been dismissed. 

I am a PHd student and considering writing a one of my thesis on this subject.

 :)  First of all, since I am writing a pHd thesis on this subject.....   I will have to make my grammar better than the above post. :-*  Second and most importantly, is there anyone who may wish to voice his or her opinions on the matter, if I ask a question or so...???  I am not looking for a full-fledged, drag out debate.

I wonder if these same laws can be used to prosecute women who didn't disclose to men that they were in a fertile period.  I know many men who were infected with fatherhood because of this nondisclosure. ;D

The courts continually rule that these men should have safeguarded themselves against this unwanted infection.

There must be statutes of limitations from state to state to protect somebody against something like a bad breakup or the fatal attraction type of person.

Every state (in the US) already has laws of the books for "stalking," "criminal harassment," "criminal menacing," and "aggravated harassment."  Certainly this is a good idea, but you do realize that what you are describing would probably fall into the category of lower-level infractions, therefore making them misdemeanor  crimes, so the punishment wouldn't be as harsh as you'd like to offer up any deterrent to prevent someone from acting in a malicious manner towards someone after a "bad" breakup.

In other words, as long as a person didn't take it to the extreme by putting a person's life in danger (by brandishing a weapon at them, kidnapping or killing them) whenever interacting with them -- the law wouldn't do much to protect the victim and the offender would get away with a slap on the wrist for making someone's life a "living hell," as that is all really subjective when it comes to the effect said behavior has on someone.

I meant statute of limitation for a charge of criminal transmission of the virus.  For example, a couple is +, but break up after, let's say, 10 years.  One would probably not have a case, if he were to file a complaint in retaliation to the break up.  This would be because of the ten+ year time lapse that the two were together.  Usually cases of the such, are 3 years max. 

I am working on a Phd in Sociology.

It IS a traditional come-hither sign.   I will assume this "resort" can function somewhat like an open air bathhouse.  I've certainly been to places like that in Key West.

Since we were not flies on the wall we don't know what happened to turn it violent.

When someone says no in these situations, you're supposed to drop it and move on to the next possibility.  Who can say but it sounds like someone didn't take no for an answer. Or maybe the victim was wiped out, wasnt looking for sex, and signals got terribly crossed!
