questions on your 2008 taxes for aids people

since I was pronounced disabled as of April of 2008 does having aids virus, qualify me for the tax deduction on my federal tax form.  I just wanted to know if anyone has dealt with this before, so I can be prepared when I go in to hr block. Thanks all LTS Big rob

I'm on SSI and don't have to file a tax return.

there's a certain level of poverty under which a tax return doesn't need to be filed. once you've been on ssd for a while, you'll hit that mark.  ;)

but if you had taxable income this year, you'll need to see if you made enough, and had enough taxes taken, to warrant filing a return. There's no special deduction for being on ssd.

The income tax credit for the elderly also applies to people that are disabled.  If you retired on disability in 2008 you may be eligible and should already have the physician's statement that you need  But you need to jump through some other hoops:  you cannot be able to work in "substantial gainful employment" and you can't earn too much (or too little).

There are other tax provisions for people on disability that may be more helpful than the tax credit, especially in the year you get SSDI.  Did you say you have a working spouse? -- if so look at the dependent provisions.  The IRS summary for disabled taxpayers last year (2007 tax year) is here: http://www.irs.gov/pub/irs-pdf/p907.pdf

When you get your W-whatever form in a month there will be a work sheet on the reverse that will tell you if you need to file or not.

If you didn't work in 2007, and went on SSDI back in Apirl 2008, you may not need to file a tax return
here an example, I went on SSDI back in 1998, but, I was on State disability for 12 months prior to that, so the last time I worked was AUG 1997, I filed a Tax return in 1998, and got a return, along with my SSDI Award letter, I got to keep my  State & Federal Tax return for working the 7 months in 1997, it didn't hurt my SSDI benefits........but , your situation my be a little different than mine, depending how much you earned when you did work?  SSDI is NOT Taxable imcome....

The links from Assurbanipal are a great source to answer your questions. If SSDI is your only source of income, you may not need to file a return. But it may not be a bad idea to see which deductions, exemptions, and credits apply to you, in case you're eligible for an earned income tax credit.

Depending on your total income from all reportable sources, filing status. etc, some of the SSDI benefits received in 2008 may be taxable. Your SSA award letter will give you the date when you were determined to be disabled. If you received any benefits paid in 2008 from a prior yr, like 2007, that will also be reported on the 1099-SSA you will receive.

Point of information is SSDI benefits ARE taxable, SSI benefits are NOT.

Hopefully, you may not need to file, but, if so, you could do it yourself filing a 1040 A or even a 1040 EZ form. It may not be necessary for you to go to a paid tax preparer, thus, saving you that expense. There are free tax preparers, like VITA, or maybe even at your ASO. The IRS will also calculate your return for you.

Be careful since there are some unscrupulous tax preparers, including some at HR Block, Jackson-Hewitt, and others who have been known to prey upon taxpayers in recent past with offers of 'refund loans', overcharging fees or even assigning refunds to themselves.

Volunteer Income Tax Assistance Program
The VITA Program offers free tax help to low- to moderate-income (generally, $42,000 and below) people who cannot prepare their own tax returns. Certified volunteers sponsored by various organizations receive training to help prepare basic tax returns in communities across the country. VITA sites are generally located at community and neighborhood centers, libraries, schools, shopping malls, and other convenient locations. Most locations also offer free electronic filing. To locate the nearest VITA site, call  1-800-829-1040.

I've never claimed this so read the details.  To claim the disability exemption you have to have received disability income via your employer (eg. disability insurance.)
