SAN FRANCISCO (AP) — A federal appeals court has declared California's same-sex marriage ban to be unconstitutional, paving the way for a likely U.S. Supreme Court showdown on the voter-approved law.

A three-judge panel of the 9th U.S. Circuit Court of Appeals in San Francisco ruled 2-1 Tuesday that a lower court judge interpreted the U.S. Constitution correctly in 2010 when he declared the ban, known as Proposition 8, to be a violation of the civil rights of gays and lesbians.

The measure, which passed with 52 percent of the vote in 2008, outlawed same-sex unions just five months after they became legal in the state.

Lawyers for Proposition 8 sponsors and for two couples who sued to overturn the ban have said they would appeal to the Supreme Court if they did not receive a favorable ruling from the 9th Circuit.

And...just last week the Washington state senate approved a bill legalizing same sex marriage, the house is expected to pass it and the governor has said she will sign it.  The zealots have already said they will force a ballot vote.

The downside is I will be forced to watch months of gay bashing tv commercials to "protect" familys.

I'm amazed at how Kim Kardashian can marry some guy for 72 days and that doesnt threaten marriage but somehow me and my partner getting married will somehow cause chaos.

I liked this part,

“Proposition 8 served no purpose, and had no effect, other than to lessen the status and human dignity of gays and lesbians in California,” the court said.

This is sure to go to the U.S. Supreme Court.  From what many "experts" said, it will probably not be before next year.  I'm just worried how this court will rule, given how political the SC has become.

Rachel Maddow did some good reporting and interviews on this tonight.  The first is with Ted Olson, who was the Bush Solicitor General and surprising proponent for marriage equality.  The 2nd is with a Slate.com legal correspondent.

The Washington state house approved the gay marriage bill today.  The Washington state governor has five days to sign the bill!
