For those of you with an interest in such matters, Criminal HIV Transmission (http://criminalhivtransmission.blogspot.com/) is compiled by one of the editors at AIDSMAP (http://www.aidsmap.com) and is a collection of articles, from around the world, about “so-called 'HIV crimes' focusing on prosecutions for sexual exposure to, or transmission of, HIV.”

I get so tired of people using the "victim" mode to prosecute other people with in regards to HIV transmission, other than when it involves children. When are people going to take responsibilitiy for their actions? It makes me think that there are so many people out there who are adults age-wise, but not mentally.

Truer words were never spoken, Vokz. It's so much easier to say "it happened because....." than "It's my fault, now let me see what I can do to remedy it."

To be honest, I wouldn’t mind so much if most of them even got as far as saying “it happened because .....” ; but most of those who wallow in victimhood seem incapable of getting beyond “WHY?”

All too often the burden is put upon those of us who are positive. And all too often this kind of thing happens...however, that being said, I think that responsibility lies with both people. Then there is the problem with people who lie about their infection and spread the virus intentionally.

In Canada it seems that only men who infect women are charged with criminal negligence. I can't recall any stories of a guy infecting another guy or a woman infecting a man being prosecuted for anything.

I couldn’t agree more.
In fact, I would go even further and say that:
- I don’t actually think that shared responsibility necessarily means equal responsibility
- Knowledge is power and knowing that you are poz gives you an extra responsibility
This is why I do still think that there are some rare extreme cases where criminal prosecutions can be justified.

Rape .. removing a condom during negotiated protected sex .. and a few other theoretical situations I can think of.
None where unprotected sex has been negotiated.

Absolutely. Sex in most cases, usually involves more than one person...If both parties agree to unprotected sex, and neither one of them discloses any communicable disease - then who is at fault?

Here's some court cases from Canada. It seems like there are more than a few cases involving gay men, women, and even the transgendered being charged. I like the one where the woman was charged with stabbing another woman with a dirty syringe. It appears justice is blind in Canada.

I can't believe how many biters there were. Who the hell bites other people? Having HIV is obviously the least of their problems...

There is a recent case in there about three young UK porn performers getting infected during a bareback shoot where all the performers were supposedly certified HIV-negative.
In that case, I actually hope the producer gets prosecuted for something (anything that will stick really). Not so much for the infections, but the fact that he still went to market with the video, with the result that sick fucks are actually hunting out and buying the video so that they can see three young men (aged 18, 21 & 26 – one of whom has learning disabilities and should never have been put in that position in the first place) getting infected.
Even worse, the strapline on the video is:
“Pack your bags and join these bright young things as they set off on a British Bareback Vacation where the only protection they will need is factor 50!”
It turns my stomach just thinking about it.
I have actually been counselling one of the lads for the last few months (but more about that another time)

Couple want legislator tested for STDs after alleged holiday kiss
HOUSTON — A Houston woman and her husband want a state lawmaker tested for sexually transmitted diseases after they claim he forcibly kissed the woman at a holiday party...
Krysynthia Rido said she fears AIDS and other sexually transmitted diseases because she was exposed to "Miles' unwanted bodily fluids." She wants the court to order Miles to undergo blood tests for sexually transmitted diseases.

well, i was exposed when my hook up removed the condom while in the act and after the negotiation of protected sex. i look at itlike this man was not my lover, boyfriend, husband or anything else, so I trusted him in a way that lead to my infection. I am responsible for my folly...he probably doesn't even know he has hiv. So there is no culpability anyhow. Prosecution on this sort of matter seems frivilous. thanks, zan

In my first medical appt, following HIV diagnosis in 1994, I was asked by the Staff Nurse... How did you get HIV? My answer... I got my HIV the old fashioned way, I earned it. ;D Have the best day
