That is  just  plain  screwed  up policy!  :o
Many states continue have rules that make it difficult or impossible for HIV-positive healthcare workers to keep working.  Here is a list compiled by the Center for HIV Law and Policy:

The States' procedures frequently include site visits and expert panels that notify the PWA/HIV's employer as part of the investigation into whether the PWA has or will endanger others.  Other states explicitly bar PWAs from a wide range of procedures.

Because courts continued to uphold the dismissal of HIV-positive healthcare workers, the notification process endangers the PWA's job.  See:

Couture v. Belle Bonfils Memorial Blood Center, 151 Fed. Appx. 685 (10th Cir. 2005) (upholding demotion and subsequent firing of phlebotomist with HIV) http://ca10.washburnlaw.edu/cases/2005/10/04-1397.htm

Waddell v. Valley Forge Dental Associates, Inc., 276 F.3d 1275 (11th Cir. 2001), cert. denied 535 U.S. 1096 (upholding firing of dental hygenist with HIV for fear he could infect others during cleanings)

The Justice department continues to address the problem of state licensing boards barring people from fields such as cosmetology on the grounds that they have an infectious disease.  http://www.aclu.org/lgbt-rights_hiv-aids/doj-tells-state-licensing-boards-and-occupational-training-schools-it-illegal-b
