Not uncommon all things considered. There have been several prosecutions of this kind here in New South Wales.

The issue for  Matty the Damned is not so much that chumps like this fella get theyselfs hauled before the courts, but by what legal device is it achieved? A law particular to HIV and HIV positive folk? Or a more general criminal offence like grevious bodily disease (an actual offence here in teh Premier State).

In Scotland the offences are 'reckless injury' and 'reckless endangerment' and as in this case 'culpable and reckless conduct' (ie reckless acts which cause injury to others or which create a risk of injury, it is said) - also been used eg for butchers who've sold poised meat, e coli tranmssion etc this one.

The problem in Scotland, as an Edinburgh lawyer pointed out to me just today, is that, theoretically, you don't have (in the case of HIV) to be HIV+ for the charge to stick....

based on what I read in the article you posted, the guy is a jerk and deserves some sort of punishment.

I was coming back, matty!  :)

I'm involved with a buddying programme for newly diagnosed people. Since this story hit the headlines I've had several very worried clients contact me asking what impact this will have on their lives. In particular, they're mostly concerned about whether they will have to disclose before every sexual contact. I always insist on use of condoms, even if the other person doesn't want them; I don't always disclose.

Personally, I feel this is a giant step backwards for pozzies.
